Glow Customer Hub Terms of Service

THESE TERMS OF SERVICE APPLY TO THE WEBSITE ADMINISTERED BY GLOW FINANCIAL SERVICES, INC. PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING THIS WEBSITE, I ACCEPT AND AGREE TO THESE TERMS OF SERVICE.

The words “I,” “me,” and “my” mean any person or entity that accesses or uses any page of the website that Glow Financial Services Inc. administers for the Total Wireless Edge loan program in its capacity as a service provider to First Electronic Bank (the “Glow Customer Hub”). The words “you” and “your” shall mean Glow Financial Services Inc. and its successors, assigns, agents, and representatives.

I understand that I should review the following Terms of Service carefully, because they govern my access and use of all materials, information, and services on each page of the Glow Customer Hub. If I access the Glow Customer Hub, I accept and agree to these Terms of Service. If I do not accept and agree to these Terms of Service, I may not access the Glow Customer Hub.

I understand and agree that these Terms of Service are in addition to other agreements, terms, authorizations, policies, and notices that apply to me in connection with the Total Wireless Edge loan program, including those you provide to me when marketing, originating, and/or servicing any Total Wireless Edge loan. If these Terms of Service conflict with your other agreements, terms, authorizations, policies, and notices, these Terms of Service will control solely as they apply to the Glow Customer Hub. These Terms of Service are not intended to modify any disclosures or other terms that are required by law. I may use this link to view information about how you collect, use, and disclose personal information about me in connection with the Glow Customer Hub.

I understand and agree my access to and use of the Glow Customer Hub is subject to applicable federal, state, and local laws and regulations. Unauthorized use of the Glow Customer Hub is prohibited. Violators can be prosecuted under applicable law.

The information and materials on the Glow Customer Hub may not be copied, transmitted, displayed, distributed, downloaded, licensed, modified, published, posted, reproduced, used, sold, transmitted, used to create a derivative work, or otherwise used for commercial or public purposes without the prior written consent of Glow Financial Services Inc.

Termination

My rights under these Terms of Service will cease without notice if I do not comply with any of its terms. In such a case, I understand that you may immediately stop my access to and use of the Glow Customer Hub.

Notices

I understand and agree that you may provide me with notices related to the Glow Customer Hub by email, text message/SMS, regular mail, or postings on the websites or apps related to the Site. I understand and agree that my use of the Site is subject to the Consent for Electronic Records and Signatures disclosure and the Consent for Electronic and Telephonic Communications disclosure that provided to me during the loan application process. These disclosure allow you to provide me with certain communications and other records electronically.

Feedback

I agree that any suggestions, comments, and feedback I submit to you through the Glow Customer Hub (“Feedback”) shall be your property. I agree you are free to use any of my Feedback, without restriction of any kind.

Disclaimer of Warranty

I UNDERSTAND AND AGREE THAT YOU ARE PROVIDING ACCESS TO THE GLOW CUSTOMER HUB ON AN “AS IS” BASIS. I UNDERSTAND AND AGREE YOU ARE MAKING NO EXPRESS OR IMPLIED WARRANTY OR REPRESENTATION. YOU DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. NO ORAL OR WRITTEN ADVICE OR INFORMATION GIVEN BY YOU CREATES ANY KIND OF WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF SERVICE.

I understand that the information contained on the Glow Customer Hub may include technical inaccuracies or errors. I also understand and agree that you may, from time to time, amend, change, add, delete, update, or alter the information contained at the Glow Customer Hub, without notice.

Limitation on Liability & Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, I ASSUME ALL RISK THAT MAY RESULT FROM MY USE OF THE GLOW CUSTOMER HUB AND ANY THIRD-PARTY SITES, INCLUDING LOSS ASSOCIATED WITH ANY COMPUTER VIRUSES. I AGREE NOT TO HOLD YOU LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RELATING TO MY ACCESS OR USE (OR INABILITY TO ACCESS OR USE) THE GLOW CUSTOMER HUB, REGARDLESS OF WHETHER THEY ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

IF YOU ARE DISSATISFIED WITH THE SERVICE, I UNDERSTAND AND AGREE THAT MY SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE SERVICE.

IN STATES WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES MAY NOT APPLY, I AGREE THAT YOUR LIABILITY IN THESE STATES IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW BUT SHALL, IN NO EVENT, EXCEED TEN DOLLARS ($10).

Indemnification

I agree that I am personally responsible for my conduct while using the Glow Customer Hub. I agree to indemnify, defend, and hold harmless you and your respective owners, affiliates, directors, officers, employees, and agents from claims, losses, expenses, liability, damages, and costs (including, but not limited to, direct, incidental, consequential, exemplary, and indirect damages), and reasonable attorneys’ fees, caused by or arising out of your use, misuse, or inability to use the Glow Customer Hub. This includes any violation by me of these Terms of Service. This provision will survive the expiration or termination of these Terms of Service.

Governing Law

Florida law governs these Terms of Service, without regard to its conflicts of law principles.

Severability

If any part of this Agreement is void or unenforceable, all remaining terms shall remain valid and enforceable.

Non-Waiver

I understand and agree that you shall not be deemed to have waived any of your rights or remedies, unless such waiver is in writing and signed by you. No delay or failure on your part to exercise any right or remedy shall be a waiver of that or any other right or remedy. A waiver on any particular occasion shall not be construed as a bar or waiver of any rights or remedies in the future.
